Article 50 has applied since 2 August 2026 and the grace period for systems already in operation ends on 2 December 2026. Emotion recognition in the workplace has been prohibited outright since February 2025.

Objective
Bring automated customer service systems into conformity with the transparency duty and verify that no prohibited practice is in use.
Scope
Every system interacting directly with natural persons: voice bots, chatbots, virtual assistants, synthetic voice and speech analytics; and any emotion recognition applied to agents.
Method
Inventory and classification of the systems in use; qualification of each feature against articles 5 and 50; review of opening and hand-over scripts; marking of synthetic content.
Deliverables
System inventory with qualification; revised scripts; conformity record; opinion on any prohibited practice identified.
Duration
Three working days, spread over two to three calendar weeks.
Audience
Any operation using automated interaction with consumers, regardless of sector or size.
Prerequisites
A list of the automated systems in use and access to the current scripts.

Articles 5 and 50 of Regulation (EU) 2024/1689; European Commission guidelines of 20 July 2026.
